In an extra ordinary meeting of the members of the Executive Committee of Jammu and Kashmir High court Bar Association presided over by President Mr. M. A. Qayoom various organizational and political matters were discussed. In the meeting it was decided to observe 27.03.2012 as Martyrs day of lawyers on the eve of 16th martyrdom anniversary of the noted lawyer and prominent human rights activist Shaheed Jaleel Andrabi Advocate, who was abducted by the territorial squad of Indian Army under the command of accused MAJOR AVTAR SINGH in the early days of month of March 1996 and his dead body was fished out in river Jehlum on 27th of March 1996 and to pay homage to Advocates Shaheed Jaleel Andarbi, Shaheed Ghulam Qadir Sailani, Shaheed Peer Hussam-ud-din, Shaheed Sheikh Mohammad Hussain, Shaheed Mohammad Sultan Bhat, Shaheed Sheikh Mohammad Altaf, Shaheed Mohammad Abdullah Rather, Shaheed Abdul Gani Bhat and others who have been martyred by the Indian Security Agencies from time to time. In this behalf it was decided that on Tuesday the 27th of March 2012 lawyers shall suspend their work across the valley in all courts including the Hon’ble High Court of Jammu and Kashmir. Further it was decided that one day seminar will be conducted on the said day at Sadder court complex Srinagar and the topic for discussion has been chosen as (Kashmir Freedom Struggle in the current Global Political Scenario and Prospectus of a solution). Prominent Lawyers, Intellectuals, Journalists, Academicians, Human Rights Activists and Prominent members of the Civil Society have been invited to the seminar as per the decision of the Bar Association. In this regard the Bar Association constituted an organizing committee for conducting the seminar comprising of Advocates Bashir Ahmad Dar, Mohammad Ashraf Bhat, Aijaz Bedar, Jawad Reshi, Bashir Sidiq, Intikhab Yousuf Parray and Mohammad Ashraf Wani headed by the Secretary of the Bar Association Advocate G. N. Shaheen.
In the meeting of the organizing committee of the seminar all the modalities were discussed and the list of the invitees was prepared accordingly. The invitation letters as per the recommendations of the organizing committee are being sent to the invitees. It was decided that the seminar shall start at 11:00 a.m. in the morning in the Sadder court complex Srinagar and all the invitees have been requested to participate in the seminar as per the schedule.
In the meeting serious concern was expressed for miscarriage of justice in Jaleel Andrabi’s murder case due to the state mechanicals and ineffectiveness of the courts to bring the accused Major Avtar Singh of Indian Army to justice. It was observed that the prime accused is never the less being identified as Major Avtar Singh who is presently enjoying in Canada on Indian Passport to the knowledge of the courts and the Govt. of India but still despite presentation of the challan in absentia of the accused before the court of law, the Govt. of India has not allowed the accused to face the prosecution and bring his to justice. The non-production of the accused before the court of law for facing trial has exposed the democratic and human rights credentials of the Govt. of India as all the official agencies are providing shelter to the accused to defeat the course of justice. In the meeting it was reiterated that the Bar Association demands the arrest and prosecution of the accused at the earliest in the ends of justice.
In the meeting all the lawyers affiliated to the J&K High court Bar Association and the District and Mufassil Bar Associations have been requested to cooperate with the decision of the Bar Association and ensure their participation in the seminar as per the schedule.
In the meeting grief was expressed on the sad demise of sister of Advocates Majid Aftab Wani and Mumtaz Wani (Ex-Secretary of the Bar Association) who has passed away yesterday on 21.03.2012. The Bar Association extends condolences on the sad demise of the sister of Majid Aftab Wani and Mumtaz Wani and express solidarity with the members of the bereaved family.
