In an extra ordinary meeting of the executive committee of the JK HCBA presided over by the President Mr. M. A. Qayoom It was decided to observe one day protest strike on Monday the 19th of December 2011 in furtherance of the demand for continuation of the registration powers of the legal documents with the civil courts and against the Govt. move to transfer the registration powers from civil courts to revenue authorities. The lawyers on this day shall not appear before the courts across the valley and members of the J&K High Court Bar Association and other district and Mufassil Bar Associations were requested to cooperate with the decision of the Bar Association and observe a protest strike on Monday the 19th of December 2011 in furtherance of the 1st phase of future course of action undertaken by the lawyers on the issue. It was hailed in the meeting that all the lawyers in the J&K share common concern on the issue and Bar Association Jammu also share same concern which the lawyers in Kashmir valley have expressed. The work shall remain suspended in all the courts on the said date.
Further it was decided that J&K High Court Bar Association reiterates its principle stand on the proposed Govt. move to transfer, registration powers of documents from civil courts to revenue authorities is unacceptable to the Bar Association and Bar Association will resist such a move and will take all possible measures in this behalf. It was demanded that the registration powers shall continue to vest with the civil courts in Jammu and Kashmir. The Govt. proposal is unreasonable and unjust as it directly effects the interests of the general public and the interests of the lawyers fraternity in particular. It was observed in the meeting that the Govt. proposal aims at handing over the registration powers from experienced and expert hands to raw hands of the revenue authorities.
It was observed in the meeting that the Bar Association has already pronounced its principal stand on this issue and for enforcing its principle stand on the issue, the Bar Association has already observed general strike on 25.11.2011 and the lawyers across the valley also took out protest demonstrations. Bar Association once again reiterates its principle position and demand that Govt. shall desist from any move for transferring the registration powers to revenue authorities.
In the meeting rich tributes were paid to Shaheed Advocate Abdul Gani Bhat on his death anniversary and it was observed that Bar Association will always remember the sacrifices given by the lawyers in the path of freedom struggle and the Bar Association shall continue to promote the cause of the people of J&K. the death or detention or other terrenes will not deter the lawyers fraternity in helping the just cause of the people of J&K.
In the meeting serious concern was expressed on the physical assault of Advocate Gh. Hassan Dar of Shopian by the litigants in a particular case on 15.12.2011 in the premises of J&K State Tribunal Srinagar. The attack on the lawyer was condemned and serious action has been pleaded against the guilty.
