The Jammu and Kashmir High Court Bar Association Srinagar describes the re-arrest and re-detention of Mohtarma Asiya Andrabi patron Dukhtarani Millat under PSA as illegal, unlawful and unconstitutional besides being in absolute violation of the orders of the Hon’ble High Court. Jammu and Kashmir High Court Bar Association Srinagar appeals United Nations Secretary General Mr. Banki Moon, Chairman United Nations Commission, Chairperson Amnesty International and other Human Rights Agencies including the National Human Rights Commission of India to intervene in the release of Asiya Andrabi as the state Govt. doesn’t allow the law of the land to take its own recourse and the present detention of the detenue is extra judicial and unconstitutional. It is submitted that the Hon’ble High court of J&K has quashed the second detention order passed against Asiya Andrabi and directed her release from the detention. But against the fundamental principles of law and constitutional order she is successively third time re-detained on identical grounds interms of the order of detention passed by the district Magistrate Srinagar Mr. Mehraj-ud-din Kakroo whose order is prima facie wrong and abuse of powers on his part. Since the concerned district magistrate is abusing the process of law by passing repeatedly orders of detention on identical grounds to defeat the judicial process, and undermine the authority of the courts contemptuously with willful intention and malafide designs to oblige the Govt. Since the matter involves life and liberty of a woman who is ailing from life taking ailments as such the Jammu and Kashmir High Court Bar Association Srinagar issues this SOS to save the life and liberty of the patron of DMK Mht. Asiya Andrabi. It is pertinent to mention here that the ailing woman was directed to be lodged in district jail Baramulla but surprisingly she is removed to Central Jail Kotebalwal Jammu for renewed lodgment in the scorching heat to damage and deteriorate the health of the DMK Patron.
The Jammu and Kashmir High Court Bar Association Srinagar condemns the re-detention of Mtr. Asiya Andrabi and condemns the executive action of lodging the ailing woman in scorching heat at Central Jail Kotebalwal Jammu. The Jammu and Kashmir High Court Bar Association Srinagar expressed its concern on re-detention and health of the DMK patron as such feels it appropriate to extend this SOS to all concerned for her safe release.
