J&K High Court Bar Association Srinagar, strongly condemns the use of brute force by Army, CRPF and J&K Police in killing more than 37 unarmed civilians and injuring about 1500 of them in different parts of Kashmir valley during the past few days of umbrage, out of whom more than 200 have received pallet injuries and are about to lose their eye sight forever.
While terming the killing of innocent civilians a systemic genocide of Kashmiri Muslims, the bar association terms the use of pallet guns as a weapon of offence, for inflicting a severe kind of injury of perpetual nature on hapless people, most of whom are teen agers to render them permanently disabled.
The Bar Association feels that the High Court, where the use of pallet guns had been questions by several members of the Bar Association in the past has also not considered the impact of such injuries and by dismissing the Public Interest Writ Petitions and the Review Petitions, it has virtually allowed the police and other forces to play with the lives of the people, without being accountable for their crime. The Bar Association feels that the matter therefore, deserves a relook and a reconsideration thereof more particularly in the context of the recent judgment of the Supreme Court which has directed that the Security Personnel cannot use excessive force in the garb of Armed Forces Special Powers Act, so that the use of pallet guns which has played havoc with the lives of the people, is ordered to be stopped forever.
The Bar Association also feels that the sending of three member team of eye specialists from AIMS, New Delhi to J&K, to assist the state in providing medical care to more than 200 pallet gun victims, who for saving themselves from police onslaught and persecution, have not even disclosed their identity to the hospital authorities, as an act of rubbing salt in the wounds of Kashmiri people, who for the last about 70 years have been facing worst kind of state repression. The Govt. of India instead of sending these three doctors to J&K State should have honored and respected their promises and assurances given to the people of Kashmir of holding an impartial plebiscite in the State under the UN auspices, so that there would be an end to their sufferings and miseries. It should have also ordered the banning of pallet guns, so as to save the people of police barbarism. When the use of pallet guns is not stopped and the police is given a free hand to use the said weapon of offence, against the Kashmiri people, day in and day out, what is the use of sending three doctors to assist the State authorities in treating more than 200 pallet gun victims, is beyond ones comprehension and clearly appears to be an eye wash to mislead the International Community.
The Bar Association requests the United Nations, Organisation of Islamic Countries and the members of International Community to take serious notice of the happenings of Kashmir and play their positive role in liberating Kashmiri Muslims from Indian Odious scourge and besides getting those punished who are responsible for the genocide and the crime committed against the humanity also raise their strong voice in getting the Kashmir people getting rid of Indian subjugation and tyranny.

J&K High Court Bar Association, Srinagar, has decided to use all possible means to persuade by mounting pressure on the UN Security Council to implement its resolutions on Kashmir and in this behalf in the first instance, has decided to write letters to all the Heads of the Member Countries of the UN Organizations to fulfil their obligation cast by UN Charter and other International Covenants on them and pressurize India to respect the rights of the people of Kashmir by allowing them to determine their political status through an independent and impartial exercise of right of self-determination. This decision was taken by the Executive Committee of the Bar Association, in a meeting, held today in District Court complex, Bemina Srinagar, where the statement of UN Peace Building Commission Chairman, Macharia Kamau, came under sharp criticism.

The members were unanimous in saying that since chapter vii of the UN Charter deals with the situations where International Agencies can resort to intervention and even Article 39 provides, that the Security Council shall determine the existence of any threat, to the peace, breach of peace or acts of aggression and shall make recommendations or decide what measures, shall be taken in accordance with Article 41 and 42, to maintain or restore international peace and security, therefore, keeping in view the situation in Kashmir and the plight of the people, who have undergone a hell, during the past 68 years, it is incumbent on the UN Security Council, to take effective steps for the implementation of its resolutions, so that peace and security is established in the sub-continent, which for the non-implementation of those resolutions, is aggravating day by day and so far, has taken the lives of about a million of people, who are fighting for their right of self-determination. It was also stated that interms of Article 42 of UN Charter, the Security Council has the power, after considering that measures taken by it, are inadequate or have proven to be in adequate, that it can take such action which is necessary to enforce its resolutions and maintain international peace and security. Such action, even includes demonstrations, blockade and other operation by Air, Sea, or Land forces of members of the UN. It was stated that since J&K has been converted into a military garrison by the Indian Forces and the human rights of the people are violated with impunity and besides use of force, there is intimidation, aggression, arrest, torture, humiliation, disappearance after arrest, custodial killings and also interference by the army in all walks of life of the people of J&K, without any accountability or fear of prosecution and punishment, therefore, for protecting the rights of the people, it is but necessary for the security council to intervene immediately, without further loss of time and get its resolutions implemented, as they have done in other places in the World, so that the safety and security of the people, whose rights have been trampled with might and power, is safeguarded without any further bloodshed. It was also stated that the people of Kashmir under UN Charter, as well as under International Covenants on Civil and Political Rights and International Covenants on Economic, Social and Cultural Rights, are entitled to live a peaceful life and have also the right to determine their political status freely, therefore, it is the bounden duty of the Security Council to come forward and save the people of the State, from the onslaught of aggression and tyranny of the Indian might in Kashmir. In this backdrop, it was also stated that the statement of UN Peace Building Commission, Chairman, being not in accord, with the UN Charter and other International Declaration of the UN, therefore, the UN Security Council should ask these authorities to desist from making any statement, which will have negative effect, on the rights of the people, but in order to uphold the human dignity and respect for human rights, impress upon the member states to concede to the right of self-determination of the people without compelling them, as a last resort to rebellion, which in the process, will disturb the peace and tranquility in the World. It was also stated that Kashmir is internationally recognized dispute and the UN by passing more than 27 Resolutions on Kashmir, has acknowledged the right of the people to decide about their future, in a free and fair plebiscite, to be conducted under the UN auspices and thus, the statement made by UN Peace Building Commission, Chairman, cannot be termed to be a realistic one, but a hotchpotch of misunderstanding of Kashmir.

The Executive Committee of J&K High Court Bar Association, Srinagar, in its meeting held today i.e., 26th of April, 2016, in High Court Bar Room, strongly opposed the decision of the Govt. to construct shelters, for the non-locals under NULM and stated that it is another conspiracy to change the demography of the J&K State, so as to reduce the Muslim Majority character of the State, into minority.

The members were unanimous in saying that the said move, shall have far reaching consequences and as it will affect and endanger, the ongoing freedom struggle of people of Kashmir and their demand to give them their right of self-determination, therefore, the aforesaid decision should be opposed tooth and nail by everyone. It was also stated that the decision was a part of the same sinister design, propounded and propagated by Hindu communalists belonging to RSS-BJP combine of settling non-State subject Army Personnel in colonies, in and around Srinagar Airport, for which even land was identified and was about to be allotted to them and therefore, it is the duty of every Kashmiri to defeat the same.

The members also expressed their anguish against the summoning of 80 students of HMT Parimpora area, daily to the police station and termed it, to be another conspiracy of Kashmir police to ruin the academic career of these students, which is inhuman and barbaric.

The members also denounced the rustication of a Kashmiri student namely Mujeeb Gutoo for two semesters from JNU University and also punishing of Umar Khalid, A. Batacharya and Kanaiya Kumar and others and described the same, as an act of victimization, resorted to by the University Authorities, to shut their mouth and not to permit them to raise their voice against the Human Rights Violation or to support the cause of people of J&K. The punishment was termed to be unwarranted, unjustified, unethical and immoral and the members accordingly sought it withdrawal forthwith.

The Executive Members also condoled the sad demise of Mr. Mohammad Amin Nehvi, Senior Advocate, who passed away on 25.04.2016 at Baghi Mehtab Srinagar. While expressing their sympathy with the bereaved family, the members paid rich tributes to Late Mohammad Amin Nehvi, Advocate for the contribution he made, in the dispensation of justice as an Advocate. It was stated that Mr. Mohammad Amin Nehvi was an honest and upright person and by his advocacy he helped the people in getting true help from the courts. The role played by Mr. Mohammad Amin Nehvi, in the freedom struggle was also highlighted and it was stated that at a time when there was a political vacuum, he came forward and under the banner of ‘Political Conference’, he projected the cause of the people to the best of his capacity and capability.

The Bar members, also condoled the death of Mr. Aman-ul-lah Khan Chairman, JKLF, and also paid rich tributes to him for the contribution, he has made in the ongoing freedom struggle.

The members also offered Fateh to both Late Mr. Mohammad Amin Nehvi and Late Aman-ul-lah Khan and it was prayed to Almighty Allah to rest their soul in peace.

J&K High Court Bar Association Srinagar, once again reiterates its stand against the proposed setting up separate townships for Kashmiri Pandits and colonies for ex-soldiers and terms the same to be a sinister design for changing the demography of the State and reduce its Muslim majority character.

In an Executive Committee meeting held today, it was unanimously stated that Kashmiri Pandits are part and parcel of the Kashmiri culture and they can live in Kashmir where they were living before and as they have migrated from Kashmir of their own, they should therefore comeback of their own.

It was also stated that there are about ten thousand Kashmiri Pandits living at present in Kashmir and when they are not asking for any separate clusters for their settlement and they are peacefully living with their Kashmiri Muslim brethren at their native places, therefore, any Kashmiri Pandit willing to return to Kashmir, will surely be welcomed by his Muslim brethren. It was also stated that the state subject law has already been neutralized through various enactments and even as of now any child born to a Kashmiri/Jammu/Ladakhi women married to a non-state subject enjoys the status of a permanent resident of J&K State and as on that basis anyone amongst them living in any part of the world can come and reside in the State it is but, natural that we should be vigilant about the same and not to allow him/them to settle in separate townships/colonies but to live in between their Muslim brethren, because if it is done otherwise, it would amount to the creating and building of a State within a State for some people, without any checks, curbs, limitations and restrictions of any kind on them. It was also stated that when for Kashmiri Muslims there are no separate townships in Jammu and other places, building such townships/clusters for Jammu Dogras is also unacceptable. The Jammu Dogras being the state subjects of the state, they too can live, anywhere, in the state, in the same manner in which Kashmiri Muslims are living in Jammu and other places. It was also stated that construction of shelters for pavement dwellers, who are non-state subjects shall have dangerous fallout on the demography of the State, because once shelters are constructed for them and those shelters are leased or rented to them they will have necessarily to be provided with all kinds of facilities at the cost of Kashmiri Muslims. It was accordingly decided that Bar Association should oppose such nefarious designs and any policy devised by pro-freedom leadership in this behalf should be supported by the Bar Association.

Meanwhile, in another extra ordinary meeting of the Bar Association rich tributes were paid to Shaheed Moulana Mohammad Farooq and Shaheed Abdul Gani Lone who have laid down their lives for the cause of freedom of Kashmir. While highlighting the role played by both of them in the freedom struggle it was stated that the people should neither forget them nor those who have given their lives for achieving the freedom from the Indian occupation and the cause which was cherished and was dear to them should be taken to its logical end.

In view of the contradictory reports about the killing of five militants by the Army, at Chak Dragmulla, Kupwara, J&K High Court Bar Association Srinagar, has decided to request Hon’ble The Chief Justice and his Companion Judges of the High Court at J&K, who are custodians of the life and liberty of the people, to take so-motto cognizance of the matter and entrust the investigation of the case, to a High Level, well reputed impartial investigating agency to find out, as to how and under what circumstances the aforesaid five militants, were killed by the army, at Chak Dragmulla Kupwara.

The Bar Association feels that when the entire population of the area maintains that the encounter was a fake and a staged one and on the handing over of the dead bodies to them, they found from the faces of the five militants that they had been killed 5/6 days before and had been brought to the village to show, that they were killed in an encounter, it becomes duty of the High court, which is supposed to be the watchdog of the legal, fundamental and constitutional rights of the people and their fundamental freedoms to show more sensitivity toward the issue and adopt a realistic and people friendly approach in finding out the truth, so that the rule of law prevails and the guilty doesnot escape the clutches of law or go unpunished.

The Bar Association also condemns the statement of Shri Lal Singh Minister of Forests, in strongest possible terms, in which he has threatened the Jammu Muslims of a repeat of 1947 and terms the same to be a sign of his mental bankruptcy. The Bar Association wants it to be known to Shri Lal Singh that killing of about half a million, innocent Muslims, both men, women and children in a ruthless manner at Satrwari, Samba and other places, on the pretext of taking them to Pakistan, is not something of which he should be proud of. It on the other hand is a blot on the communal forces of Jammu and he, besides being ashamed of the same, should have made mends in his behavior and assured all possible help, to the Jammu Muslims, who had gone to meet him at his residence, rather to rebuke and threaten them of the repeat of 1947 and turn them out of his home. The Bar Association feels that Shri Lal Singh, having forfeited his right to represent any segment of the Jammu society, should be immediately sacked, so that people like him, when in power, do not injure the sentiments of the people of the other faith. The SHO Police Station Gandhi Nagar, has termed the threatening of little significance also deserve to be removed from his office and the incumbent posted in his place deserves to be directed to investigate the FIR lodged against Shri Lal Singh, strictly in accordance with law, without getting influenced or overawed, by any means whatsoever.

J&K High Court Bar Association Srinagar, while terming the statement of Mehbooba Mufti, given by her in the State Legislative Assembly, yesterday, regarding migrant Pandits and Sainik colonies ridiculous and deceptive, once again makes it clear that it will oppose all moves of the Govt. to settle migrant Kashmiri Pandits in separate clusters, whether on temporary or permanent basis or to establish Sainik colonies for ex-servicemen in any part of the valley.

In an Executive Committee meeting held today, it was stated that when more than fifteen thousand Kashmiri Pandits, can peacefully live with their Muslim brethren in different parts of the valley, why should there be exclusive colonies or transit accommodations for Kashmir migrant Pandits, anywhere. Similarly, why ex-soldiers can’t live at their native places, rather than be settled in Sainik colonies. If those ex-soldiers are really in need of a plot of land for construction of their houses, what prevents the State Govt. to provide them the said plot of land in the village or Mohalla where they are putting up alongwith other members of their families. Why is it necessary to establish residential colonies for the ex-soldiers and once they are settled in those fortified colonies, what is the guarantee as to who would live there. Would not these Sainik colonies or transitory or permanent clusters and townships become a den of conspiracies against the people of Kashmir and would not those who live in these colonies and clusters indulge in all sort of activities aimed at to undermine and diminish the Muslim majority character of the state. Is it not a fact that RSS which is running the Govt. and ruling India at present has an agenda for weakening the ongoing freedom struggle of the people of Kashmir and do they not believe in the philosophy that “Kashmir has a vast space for expansion of population and if industrialized, it can absorb crores of people from India”. It was therefore, stated that it is everybody’s responsibility to oppose such nefarious plans tooth and nail.

The Executive Committee members also condemned the unlawful arrest and detention of Mohammad Yasin Malik Chairman, JKLF, who was arrested five days back and lodged in a police station and since then has not been produced before any court or magistrate for obtaining remand against him. The executive committee members also condemned the continuous house arrest of S.A.S Geelani and other pro-freedom leaders who are not been allowed to move out of their houses or to offer their Friday prayers in the mosques.

The Executive members of the Bar Association requests the UN Human Rights Organizations, Amnesty International, Asia Watch and other Associations of the World to take notice of events which are taking place in Kashmir and play their positive role in getting the Kashmir issue settled in accordance with the wishes of the people.

J&K High Court Bar Association Srinagar, strongly condemns the murderous attack on Mohammad Yasin Malik, Chairman JKLF, by J&K Police on Friday night, a few hours after his release from Central Jail Srinagar:- ransacking of his house and damaging his household goods and other valuables; locking his mother and sister in a secluded room, abusing and beating of women protesting against the said raid and firing teargas canisters into the kitchen of the house of Hilal Ahmad War and injuring three minors over there, one of whom later received 11 stitches as first aid and terms the same a barbaric act of ruthless forces, who are all, law unto themselves and fear none, while executing illegal, unlawful and nefarious designs of their masters, sitting in Delhi.

The Bar Association while expressing its solidarity with Mohammad Yasin Malik and other pro-freedom leaders and activists, who have either been put under house arrest or have been lodged in police stations or jails for peacefully protesting against the evil designs of Indian Govt. and its stooges in the state, to set up Sainik colonies for ex-soldiers and to construct separate clusters for Kashmiri Migrant Pandits and also against the implementation of new industrial policy, once again makes it clear that unless we unite and oppose the sinister design of BJP-RSS combine, there is every possibility of their succeeding in changing the demography and in diminishing its Muslim majority character of the state.

The Bar Association also wants to inform the people that the reported huge construction of 47 apartment blocks at Old Airfield area Srinagar, which has been going on for the last two years, should be treated as an alarm bell for understanding the wicked policies of the Govt. of India and its agents in Kashmir, who despite the stip opposition from the people are going ahead with the implementation of their nefarious policies, to strengthen their forcible occupation of Kashmir and to settle non-state subjects in the valley, under the false cover of constructing shelters for pavement dwellers and colonies for ex-soldiers.

The Bar Association while reiterating its stand of opposing all such sinister plans, also makes it clear that the new move of BJP-RSS combine to conduct Abhinav Gupt Yatra in Beerwah Budgam, is manifestly an act of cultural and religious aggression on Kashmiris. It is also aimed at to flare-up communal tension in State, so that the communal forces, who are at the helm of affairs, get a chance to implement their policy of genocide of Kashmiri Muslims, which is the agenda they have been following, for weakening the freedom struggle of the people of Kashmir, who are fighting for their right of self-determination for the last 70 years and are seeking implementation of the United Nation Resolutions in that behalf. The Bar Association request the people to oppose the said proposed Abhinav Yatra also, because if the said yatra is allowed to take place, it will cause irreparable injury to the cultural and religious ethos of Kashmiri Muslims.

J&K High Court Bar Association Srinagar, express its grief over the sad demise of Ghulam Mohammad Khan, the father of Nayeem Ahmad Khan, Chairman National Front.

In a condolence meeting held today, at J&K High Court Bar President’s, rich tributes were paid to the deceased and the sacrifices made by the deceased and his family members in the ongoing freedom struggle, were remembered.

Later a delegation of the Bar Association headed by its President Mr. M.A. Qayoom, Advocate, which included Mr. Aijaz Bedar, Vice President, Mr. Mufti Mehraj-ud-din, Advocate, Mr. Rafiq Ahmad Joo, Advocate, Mr. Mushtaq Ahmad Dar, Advocate, Mr. Mohammad Abdullah Khanday, Advocate and Mr. Mian Muzaffar, Advocate, went to the residence of deceased and expressed their sympathy with the bereaved family, particularly with Nayeem Ahmad Khan.

The members of the delegation also offered Fateh to the deceased and prayed to Almighty Allah to rest his soul in peace and give courage and fortitude to the bereaved family to bear the loss.

In the aforesaid meeting, a number of issues concerning the Bar, were discussed and decisions were taken thereon.

The Executive Committee members, on the first death anniversary of Siraj-ud-din Shah, Advocate, which fell on 12.06.2016, also paid rich tributes to the departed soul and prayed Almighty Allah to rest his soul in peace. They also expressed once more, their solidarity with Jahan Ara, Advocate, the widow of the deceased, who despite all odds, has held the family of the deceased together and in these hard and troubled days has succeeded in sustaining herself and the family.

The Executive Members also paid rich tributes to Tufail Ahmad Matoo, on his 6th Death anniversary and also pray to Almighty Allah to give courage to his family members, who have been valiantly fighting a legal battle for the last six years, to bring the killers of Tufail Ahmad Matoo to book, so that they are punished for the heinous crime committed by them. It was also decided that the case filed in the High Court by Manzoor Ahmad Matoo against the killing of Tufail Ahmad Matoo, shall be taken to its logical end and no stone will be unturned in getting the closure report filed by the police, in the court of CJM Srinagar, dismissed. It was also decided that every kind of legal assistance will be kept available to the family members of Tufail Ahmad Matoo and in this regard every executive member shall play his part, effectively.

The Executive Members also condemned the registration of a frivolous criminal case, by police Rajouri, against Showkat Ahmad Thakur, Advocate, who had gone to Rajouri to plead the case of his client, before the Women’s Police Station Rajouri and had sought dismissal of the same, but instead of dismissing the case, the police have booked him in the matter under section 109 RPC, which evidently it had no authority, power of jurisdiction to do. It was also stated that the allegations leveled against Showkat Ahmad Thakur, Advocate were unfounded and baseless as he was neither related to the party nor had any bias against his opponent. He had gone to Rajouri to fulfil his professional obligations and had tried his best to defend his client which was otherwise also obligatory on him. It was decided that the matter will be brought to the notice of the Hon’ble Chief Justice, so that the honour, reputation and prestige of any lawyer, is not harmed and for performing his professional duties, he is not booked in a false and frivolous case and not only he, but his family as well, is not harassed or threatened of any consequence.
